THE 58th complaint for murder was filed before the Department of Justice (DOJ) after the family of photojournalist Reynaldo Geneblaza Momay on Thursday argued that he was one of the victims in the gruesome Maguindanao massacre case.
In a complaint affidavit, Momay’s daughter, Ma. Reynafe Momay-Castillo accused patriarch Andal Ampatuan Sr. and his son Datu Unsay Mayor Andal Ampatuan Jr. and several others as respondents in the case.
It was stressed by Momay-Castillo that lamented that her father, who used to work for Tacurong City based Midland Review, was not included in the list of victims because his body could no longer be found.
But it was averred that her father’s dentures were recovered from the massacre area at the Ampatuan town in Maguindanao on the date of the massacre. The said dentures was able to identify allegedly the said victim.
Up to present the said victim was not yet declared dead or presumptively dead by law.
According to Atty. Gilbert Andres, lawyer for the Momay family, there is another victim that the government should take cognizance with.
“We opted to file our complaint to remind the DoJ that there is still another victim whose case is not among those being tried in court,” Andres pointed out.
It will be recalled that the gruesome Maguindanao Massacre happened on November 23, 2009 by killing 57 civilians, more than half of the slain victims were journalists, in Sitio Masalay, Barangay Salman, Ampatuan town in Maguindanao.
They were ruthlessly killed, including the wife, two sisters, lawyers, aides and motorists of now Maguindanao Gov. Esmael Mangudadatu, through multiple gunshot wounds and their bodies and vehicles were interned with the use of a backhoe.
With this, the DOJ indicted Andal Sr., Zaldy, Anwar and Akmad Ampatuan and several others for the crime of multiple murder.
